The Collective Bargaining Agreement

Article 11 of the Agreement (CBA) between APSCUF and PASSHE establishes many of the procedural requirements for conducting searches and hiring faculty, including temporary and regular part-time faculty.  The University is bound by contract law to follow these requirements.

Provisions in Article 11 include the role of the chair, department faculty, and the President in the hiring process, and how disputes as to the suitability of candidates should be handled.  It also includes a brief discussion of conflicts of interest and recordkeeping in searches, as well as certain periodic information which must be provided to APSCUF regarding faculty census.

The CBA contributes to the consistency and transparency of faculty searches.  Interpretation of some CBA provisions, however, can sometimes be challenging.   There may also be times when other articles of the CBA integrate with Article 11, without being apparent by a simple reading of Article 11.   If questions arise regarding any aspect of the CBA, it is prudent to consult a Labor Relations Specialist in the Office of Human Resources, or your local ASCUF representative for clarification.
